ACCEPTANCE OF TERMS By using the web version of **Case Digestor** ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App. * **Updates:** When these Terms are updated, continued use of the App constitutes acceptance of the new Terms, regardless of whether you formally acknowledge the notification. * **Security:** Your case files are processed in-memory and never stored on our servers. Only the generated digest is saved to your secure, encrypted library. We use Supabase (hosted in Singapore) with bank-level encryption. You can delete any data anytime from your profile. ## 2. DESCRIPTION OF SERVICE The App provides AI-assisted case digest generation for Philippine jurisprudence using state-of-the-art frontier large language models. It is designed as a study aid and a legal research tool. ## 3. USER RESPONSIBILITIES You agree to: * Use the App for lawful purposes only. * Not rely solely on AI-generated content for legal matters. * Verify all case information against official sources (Supreme Court E-Library, Official Gazette, SCRA, etc.). * Not share or redistribute digests as official legal documents. * Maintain confidentiality of any sensitive case materials you upload. * Consult the original opinion and a qualified lawyer for practice or litigation matters. ## 4. INTELLECTUAL PROPERTY * **Our Rights:** The App, its design, source code, and algorithms are owned by **LEGAL BAI**. * **Your Rights:** User-uploaded documents remain your property. By uploading documents, you represent and warrant that you have the legal right to use such materials. * **Attribution:** AI-generated digests are provided for personal/professional use. If you publicly share or distribute any output from the App, it must contain attribution that the work was generated using **Case Digestor by LEGAL BAI**. ## 5. DATA PRIVACY * **Storage:** Your profile and usage data are stored on our secure servers. Case documents are processed in-memory via secure API and are never permanently stored on our servers. * **Compliance:** We operate subject to **Republic Act No. 10173 (Data Privacy Act of 2012)**. We do not collect, sell, or share user data with third parties. * **Rights:** You have the right to access, correct, and delete your personal data. ## **6. PAID SERVICES: SUBSCRIPTIONS AND CREDITS** **6.1 Subscription Plans.** Some parts of the Service are available only with a paid subscription ("Pro Plan"). You will be billed in advance on a recurring and periodic basis (monthly or annually). * **Monthly Allocation:** Subscribed users receive a specific allocation of credits ("Plan Credits") at the start of each billing cycle. * **Automatic Renewal:** Your subscription (and the associated credit reset) will automatically renew under the exact same conditions unless you cancel it. **6.2 Credit Types and Validity.** The Service may utilize two distinct types of credits with different validity periods: **(a) Plan Credits (Subscription):** Credits allocated as part of your monthly or annual subscription **reset** at the beginning of each new billing cycle. Unless explicitly stated otherwise in your plan description, unused Plan Credits **do not roll over** to the next billing period and will expire at the end of the current cycle. **(b) Purchased Credits (Top-Ups):** Credits purchased separately from a subscription (e.g., "Credit Packs") are valid **indefinitely** provided your account remains active. These credits are consumed *after* your Plan Credits are exhausted. **Definition of Active Account:** An account is considered "active" if you: - Log in to the Service at least once within any 24-month period; OR - Have an active paid subscription with automatic renewal enabled; OR - Make a purchase or redemption (credit top-up, subscription upgrade, etc.) within the 24-month period. **Dormancy Notice:** If your account has been inactive for 18 months, we will send an email reminder to your registered email address notifying you that your account will be considered dormant in 6 months. You may reactivate your account at any time by logging in. **Effect of Dormancy:** Accounts that have been inactive for 24 consecutive months will be marked as dormant. Dormant accounts retain all Purchased Credits (Top-Ups) but may be subject to suspension. We will provide a 90-day grace period after the dormancy notice before any Purchased Credits are forfeited, during which you may log in to reactivate your account and retain all credits. **Bonus Credit Expiration:** Bonus Credits awarded through referrals, promotions, or other means will be reset to zero if a free-tier account has been inactive for 6 consecutive months. Paid subscribers are exempt from this policy. **6.3 Payment Processing.** Payments are processed securely through third-party providers (e.g., **PayPal, GCash, Coins & Maya**). We do not store your payment card information. By making a purchase, you agree to the terms of the applicable payment provider. **6.4 Taxes.** All fees are inclusive of applicable taxes unless stated otherwise. You are responsible for any additional duties or levies imposed on digital purchases by your local jurisdiction. **6.5 Refunds and Cancellation.** * **No Refunds:** All purchases (Subscriptions and Credit Packs) are final and **non-refundable**, except where required by applicable law. * **Effect of Cancellation:** If you cancel your Subscription, your access to **Plan Credits** will continue only until the end of your current billing cycle. After the cycle ends, any remaining Plan Credits will be forfeited. **Purchased Credits** (Top-Ups) will remain in your account even after subscription cancellation, provided your account is not terminated for violation of these Terms. **6.6 Referral Program and Bonus Credits** **(a) Program Mechanics.** Registered users may be eligible to earn bonus Credits ("Referral Credits") by sharing a unique invite code with new users. Referral Credits are awarded only when a new user successfully registers and/or completes a qualifying action using your unique code. **(b) No Cash Value.** Referral Credits are promotional in nature, have no cash value, and **cannot be exchanged for money**, refunded, or transferred to other accounts. **(c) Prohibited Activities.** You agree not to abuse the Referral Program. The following activities are expressly prohibited and may result in the immediate termination of your account and forfeiture of all Credits: * **Self-Referral:** Creating multiple accounts to invite yourself. * **Spamming:** Distributing your invite code via unsolicited email, SMS, or automated scripts. * **Misrepresentation:** Impersonating **LEGAL BAI** or claiming to represent us while sharing your code. **(d) Right to Revoke.** We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals in our sole discretion as deemed fair and appropriate. ## 7. DISCLAIMER OF WARRANTIES; NO LEGAL ADVICE **7.1 "As Is" Basis.** The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. * **AI Limitations:** The App generates AI-assisted summaries that may contain errors, omissions, or hallucinations. **This is NOT a substitute for reading original case decisions.** **7.2 No Professional Legal Advice.** **CASE DIGESTOR IS A LEGAL RESEARCH TOOL, NOT A LAW FIRM.** * The content provided is for educational purposes only and does not constitute legal advice or opinion. * **No Attorney-Client Relationship:** Use of the Service does not create an attorney-client relationship between you and **LEGAL BAI**. * **Verification:** Users **MUST** verify all information against official jurisprudence. We assume **NO LIABILITY** for any decisions, actions, or outcomes arising from reliance on generated digests. ## 8. LIMITATION OF LIABILITY **8.1 Exclusion of Damages.** To the maximum extent permitted by applicable law, in no event shall **LEGAL BAI**, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to **loss of profits, loss of data, loss of business, or failure to win a legal case**, arising out of or in connection with your use of the Service. **8.2 Liability Cap.** In no event shall our total aggregate liability to you for all claims exceed the amount you paid to us for the Service during the **twelve (12) months** immediately preceding the claim. ## 9. INDEMNIFICATION You agree to defend, indemnify, and hold harmless **LEGAL BAI** and its officers, directors, and employees from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: 1. Your use of and access to the Service; 2. Your violation of any term of these Terms of Service; 3. Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or 4. Any claim that your use of the Service caused damage to a third party. ## 10. GOVERNING LAW AND DISPUTE RESOLUTION **10.1 Governing Law.** These Terms shall be governed by and construed in accordance with the laws of the **Republic of the Philippines**. **10.2 Amicable Settlement.** In the event of any dispute, the Parties agree to first attempt to resolve the dispute through good faith negotiations for a period of at least thirty (30) days before resorting to any judicial proceeding. **10.3 Exclusive Venue.** Should the parties fail to reach an amicable settlement, any legal suit, action, or proceeding arising out of or relating to these Terms shall be instituted **exclusively** in the appropriate courts of **Cebu City, Philippines**, to the exclusion of all other courts of equal or competent jurisdiction. ## 11. TERMINATION **11.1 Right to Terminate.** We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms (e.g., account sharing, scraping, or non-payment). **11.2 Effect on Data.** Upon termination, your right to use the Service will immediately cease. We shall have **no obligation to maintain or provide any of your data** (including saved digests) and may delete all User Content from our systems. ## 12. GENERAL PROVISIONS **12.1 Force Majeure.** We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including acts of God, typhoons, internet service provider failures, or war. **12.2 Severability.** If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect. **12.3 Entire Agreement and Incorporation.** These Terms of Service, together with the **Privacy Policy** (available at [[https://www.casedigestor.app/privacy](https://www.casedigestor.app/privacy)]), constitute the entire agreement between you and **LEGAL BAI** regarding the Service and supersede all prior agreements. **The Privacy Policy is hereby incorporated by reference into these Terms.** ## 13. COMMUNICATIONS AND MARKETING **13.1 Consent to Electronic Communications.** By creating an account on the Service, you agree to subscribe to newsletters, marketing or promotional materials, and other information we may send. You acknowledge that these communications are part of the "Freemium" nature of the Service. **13.2 Opt-Out Mechanism.** You may opt out of receiving any, or all, of these marketing communications from us by: Following the "unsubscribe" link or instructions provided in any email we send; or Adjusting your communication preferences in your Account Settings. **13.3 Service-Related Messages.** Please note that even if you opt out of marketing emails, you will continue to receive mandatory service-related messages (e.g., password resets, billing confirmations, changes to Terms of Service, and security alerts), as these are necessary for the administration of your account. ## 14.
